TERMS AND CONDITIONS FOR SALE

Please read these terms and conditions carefully as it governs the relationship between you and us, when you purchase products from us by the internet, phone or from our offices. By accepting these terms and conditions you are forming a contract with us and agreeing to the terms and conditions that appear below. References to “you” \"your\" and “yourself” are to you as an individual or an organisation. References to “us”, “our” and “we” are to AEB solutions ltd., company number 07113486, Registered office 'Posh, 11 Norton Avenue, Heysham, Lancashire, LA3 1HE'.

0 Deliveries

0.0 All deliveries either made by ourselves or third party that arrives damaged in transit will be in our liability for that damage to the limit of its repair, replacement or refund of the goods thereof though must be reported within 48 hours of receipt. Reports of damage outside this period will not be considered.

0.1 Exact time of the delivery is not of the essence. We will not be responsible for any loss or damage incurred through any responsible delay or delay by unforeseen circumstances outside our control.

0.2 All damages must be noted and signed for as such at the time of delivery. You should fully check all items upon delivery arrival and in the case of a palletised delivery, you have an allocated 20 minutes for inspection and offloading. Please report any damages to the driver and clearly mark the delivery sheet as such detailing the damage and contact us immediately. Signing a sheet "Damaged" will not suffice for insurance reasons and no measure of consideration can be given to a later claim

Any damages not visible at the time of delivery i.e any internal damages must be reported within 48 hours of delivery under the terms of the insurance. Do not store your items away please ensure your check the contents within 48 hours. Failure to do this will result in the loss of the ability to claim for these items under warranty for parts aesthetically damaged.

1. Your Order

1.1 Each order placed by you with us shall be an offer by you to us, to buy products subject to the terms and conditions.

1.2 No order you place shall be deemed to be accepted by us until we have received full payment from you and issued a confirmation of the order.

1.3 You must ensure that the terms of your order, including the address for delivery, are complete and accurate, any failure to make delivery due to inaccurate information supplied may result in an additional charge for delivery to the customer. Failure to complete a delivery due to persons not present on an agreed date will only be redelivered once an additional delivery fee has been paid by the purchaser. If the goods are to be returned to us a delivery fee will be taken and deducted from any refund.

1.4 All quotations and advertisements for products given on this website are given on the basis that no contract for sale shall come into existence between us and you until we have received full payment from you and issued an acknowledgement of your order. Any quotations or advertisements for products given on this website may be altered or withdrawn by us at any time.

1.5 We shall endeavour that all orders are met. We do not, however, guarantee the availability of any product upon initial order. Where a product is temporarily out of stock we will advise you of when we expect to be able to fulfill orders or offer an alternative, any estimate replenishing of stock, however, this is an estimate only and shall not be binding upon us.

1.6 Sometimes stock may be withdrawn or discontinued. We shall make every effort to update the website at all times, but you understand and acknowledge that we are not liable to you for any failure or delay to fulfill an order due to products being out of stock, withdrawn or discontinued.

1.7 Once an order has been placed by you and accepted by us you have a right to cancel the order within 7 days, unless delivery has been arranged (left our possession) or completed, except for custom made or products adapted for you which may be cancelled at our discretion in exceptional circumstances only. In all cases, once work has started for custom made and alterations then cancellation will not be accepted. Once an item leave us for delivery, a cancellation will incur charges from delivery company for the delivery and then a further for the return which are to be covered by the purchaser

1.8 Sales by auction are final and cannot be cancelled whether by online auction or face to face auction.

1.9 To cancel or return an untouched and uninstalled item due to the fault of the customer, for example, reasons including but not exclusive to an inappropriate installation environment or unit unsuitability, incurs handling and restocking charge of up to £150 or 10% whichever is the greater, except for orders of custom made or adapted goods which are not returnable.

1.10 Although delivery is included in the price and not billed as a separate item on the invoice, a collection cost will be enforced for collections made by ourselves depending on the location of the pick-up. For further information please see \'Returns and Refund Policy\' below

1.11 Unit measurements are for reference and are a guideline only though we will endeavour to keep these as accurate as possible. Our products will require additional room for manoeuvre and 'sitting'. Full access for future maintenance should be allowed. All measurements given are not absolute and are provided by the relevant manufacturer, any return due to ill-fitting due to size will be a chargeable return with relevant re-stocking charge.

2. Installation

2.1 All items unless otherwise stated are intended for a "DIY" install. We cannot be liable for any costs relating to professional or paid service for any reason. For example, faulty item replacement missed delivery or missed trade persons or professionals appointment

2.2 You must comply fully with all additional instructions laid on in the relevant manufacturer terms and conditions, instructions and literature supplied.

3. Price and Payment

3.1 Unless otherwise agreed between you and us, the price for the products shall be the price as published on the date of the order.

3.2 The price for the products shall be inclusive of VAT and inclusive of all fees and charges in relation to packaging and carriage to the delivery address but the costs may not be shown separately.

3.3 Payment for the price of the products shall be due in pounds sterling at the time of the order.

3.4 Time of payment shall be of the essence and no payment shall be deemed to be received by us until it has been received in full and funds cleared.

3.5 We reserve the right to charge extra for delivery, though this will be upon prior notice before the delivery itself.

3.6 The 'Price match promise' offer relates to online advertised prices only. The deal excludes any personalised deals, offers/promotions or quotes or any 'special prices' or sales and auction websites such as eBay or private listing sites/
The 20% off relates to an additional 20% off the difference in price. For example, if our price is £100 and a competitor's price is £80 on the exact same item, we would match the £80 and add an extra 20% of the difference of £20 (£4) making our price £76

3.7 We reserve the right to correct any pricing errors

3.8 We reserve the right to charge a handling fee for failed deliveries due to a customer not being available on the pre-arranged date

4. Warranties

All warranty terms need to be sought from the relevant manufactures website for specific terms relating to the product outside of the terms of the sale, further information may be supplied with the unit and MUST be read before commencing installation. Proceeding with installation is an acceptance of these terms and that of the manufacturer.

4.1 All warranties, conditions and other terms implied by state or common law are, to the fullest extent permitted by law, excluded from this Agreement.

4.2 All products carry the warranty stated on the product description, advertisement or on the relevant manufacturer website which may be subject to certain criteria such as that of installation must be carried out by qualified installers or professionals. All items are covered for supply only of replacement parts unless otherwise stated. Further warranty \' upgrade\' or extensions may be available on some products

4.3 The parts warranty is a manufacturer\'s warranty and parts will be supplied by the respective manufacturer, immediate dispatch of parts is not guaranteed.

4.4 In the event of the product requiring replacement or repair under the warranty, you must contact us immediately upon discovery of the fault. Any delay may cause further issues may not be met by the warranty.

4.5 All items should be checked for any signs of damage and you must ensure you have the correct item BEFORE commencing installation, we cannot be responsible for any costs incurred by installation delays.

4.6 We do not accept any responsibility for slow or unacceptable drainage of water from the unit due to incorrect waste pipe or the \"fall\" of the pipe not being great enough.

4.7 In respect of items made of plastic, ceramic, wood, glass, marble or similar no guarantee can be given against crazing, variation in shade, staining, and variation in patterns of different batches. Under no circumstances can the seller take any responsibility once the product has been fixed. All performance data or any other information in printed or electronic media is purely for guidance only and whilst given in good faith shall not bind us. The liability of the seller shall, in any event, be limited to some rights as the seller may have against its suppliers and not exceed the value of the goods.

4.6 Any extended warranties bought from ourselves carry on to the unit from the date when the standard warranty expires. They cannot be bought at any time after the initial sale of the unit unless we choose at our discretion

4.7 We, our suppliers or the manufacturer reserve the right to see evidence of professional installation by qualified installers in the case of the electrics for some products. Failure to produce this evidence will render the warranty being void in the case of an electrical fault.

4.8 Customising, amending or adapting a product may also render the warranty being void

4.9 Colours shown in any media are for guidance only and may not represent a true representation due to the limitations of printing and display in an electronic form

4.10 Warranty is a parts only warranty unless otherwise stated. Any installation costs to correct any issues will not be covered by us

4.11 Items offered, advertised or given as \'free gifts\' or promotion product are not covered by any warranty

4.12 for warranty claims or damage reports we reserve the right to require photographic or electronic media evidence of the damage or \'proof\' to confirm the report of issues

4.13 Further to any parts warranty and due to the nature of the products and the fact some defacing during installation, once a unit is installed no full unit returns can be made. Units are sold in kit and any damage parts present before installation MUST be reported prior to installation. Once installation commences, the unit enters the parts warranty coverage

4.14 While we try to have all images and descriptions on site as accurate as we can when representing an item/product. Slight changes in colour or design may occur without notice, These are due to continued refinement and 'upgrading' of items by the manufacturer. Normally any changes are a result of product improvement

5. Returns and Refund Policy

5.1 In the event that any order is incorrect on our part, it will be taken away at no charge and the correct items installed on a rearranged date.

5.2 In the case of incorrect orders on our part, the products shall be returned to us and we shall redeliver the correct order at our own cost.

5.3 To cancel or return an untouched and uninstalled item due to fault that is not ours, for example, an inappropriate installation environment not being met as instructed on the installation page of the website and installation guide or unit unsuitability, incurs a handling and restocking charge of up to £150 or 10% whichever is the greater, except for orders of custom made or adapted goods which are not returnable. Although delivery is included in the price and not billed as a separate item on the invoice, a collection cost will be enforced for collections that are made by ourselves depending on the location of the pick-up, although liability for the return of the item is the responsibility of the customer/purchaser. In line with the long-distance selling act, you have 14 days from receiving the goods to request cancellation

5.4 If we elect to refund you by agreement between us and yourself rather than provide a replacement or repair for the faulty or defective product, or we are unable to replace any faulty or defective product, the products may be required to be returned to us, and shall become our property.

5.5 For any sort of return you must contact our after-sales department and obtain an RMA (Return Merchandise Authority) which must be clearly marked on a label outside of the packaging and on any documentation. Without this goods will be refused by our goods inward department.

5.6 If any goods or items are returned due to the fault of the customer including but not exclusive to wrong item order, incorrect install environment or inappropriate room available, the restocking charge will be enforced and the return of the unit is at the expense of the customer.

5.7 If the pick up of units it is required, the unit must meet the standard \'palletised\' conditions that courier delivery requires. An example of this will be as per the unit upon arrival. Failure to do this will result in non-pickup of the item and any further pickup will be chargeable. For further details please contact customer service

5.8 Any boxes that have been opened and are to be resealed MUST be resealed with CLEAR TAPE ONLY. Please DO NOT use brown or duck tape as this grades the boxes. If the event any tape other than clear tape is used a charge of £50 per box will be applicable for replacing the box and processing

5.9 For hygiene reasons, personal products such as, but not limited to, infrared and traditional saunas, showers, whirlpool baths and portable saunas cannot be returned after any usage due to health restrictions once they’ve been opened and/or installed.

6. Limitation of Liability

6.1 Without prejudice to the other provisions in these terms and conditions, these provisions set out our total financial liability to you.

6.2 All times given for installation, restocking etc are estimates only and we shall not be liable for any damages, costs, losses (including without limitation pure economic loss, loss of profit, loss of business, interruptions to business, depletion of goodwill or reputation, and/or loss of commission), claims or liabilities, whether direct, indirect or consequential, incurred by you due to any delay by us, including if such delay was caused by our negligence.

6.3 Nothing in this agreement shall limit our liability for death or personal injury caused by our negligence or for any matter for which it would be illegal for us to attempt to exclude our liability or for fraud or fraudulent misrepresentation.

6.4 Without prejudice to the other provisions of this agreement, our total liability in contract, tort (including negligence or breach of statutory duty) misrepresentation, restitution or otherwise, arising in the performance or contemplated performance of this contract shall be limited to the price of the products in any single order. We do not cover consequential loss.

6.5 All products sold by us are for use in domestic situations only and are not for commercial use unless otherwise stated.

7. Waiver

7.1 If you breach any provision of these terms and conditions and we ignore this, we shall still be entitled to use our rights and remedies at a later date or in any other situation where you breach any provision of these terms and conditions.

8. Assignment

8.1 We may transfer and/or assign our rights or obligations under these terms and conditions at any time. This will not affect your rights and/or obligations under the terms and conditions. You are not permitted to transfer your rights or obligations under these terms and conditions to any other person.

9. Invalidity

9.1 If any provision of these terms and conditions is found by a UK court in England, tribunal or administrative body of competent jurisdiction, to be wholly or partially illegal, invalid, void, voidable or unenforceable it shall, to such extent, be deemed to be severable and the remaining provisions of the terms and conditions and the remainder of the provision shall continue in full force and effect.

10. Privacy

10.1 All information that you provide about yourself to us shall be used in accordance with our privacy policy.

10.2 You acknowledge that you have read and agree to be bound by the terms and condition listed here upon purchasing your item.

10.3 No financial information/ card details are kept or stored on either paper or on a computer

11. Force Majeure

11.1 Should any event occur at the seller's premises or elsewhere which is beyond the seller's control i.e. industrial action (including strike or lockout) shortage of materials, act of God, war, riot, commotion, fire, flood, breakdown of machinery, or as a result of which the performance of which this contract is prevented or delayed then:-

11.1(a) Without prejudice to its rights in the event of a breach of contract by the buyer, the seller reserves the right to cancel delivery or other performance of the seller's obligations under any contract in whole or in part and in the event of part of the contract, less any expenses incurred by the seller to date of the cancellation in part performance of the contract;

11.1(b) If such prevention or delay continues for 90 days - the buyer may elect to cancel the contract or allow the order to remain on the seller\'s books to be completed at a later stage

12. Variation

12.1 We reserve the right to unilaterally vary these terms and conditions from time to time. You should check and read the terms and conditions for any updates and/or amendments before placing any order with us. If you do not agree to any of the terms and conditions at any time you should not place an order with us.

13. Third Party Rights

13.1 We and you do not intend that any provision in the Terms and conditions shall be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to these terms and conditions.

14. Governing Law and Jurisdiction

14.1 We shall endeavour to resolve any disagreements between us and you quickly and efficiently. The agreement between you and us shall be governed by the laws of England and Wales and you and we shall both submit to the exclusive jurisdiction of the courts of England and Wales.

TERMS OR WARRANTY FOR OUR IN HOUSE BRAND OF STEAM SHOWERS

ESSENCE OF THE WARRANTY

Any parts or component of the shower proven to be defective within the warranty period will be replaced under the terms herein. You should read this literature in full prior to your purchase and understand and accept the terms herein prior to purchasing.

We reserve the right to request both photographic evidence and/or a return of any shower part for testing of any item being claimed for under warranty before a replacement is agreed to be supplied.

In the case where a return is requested, the returns postage will be paid by us, we will arrange a courier collection on an agreed date or refund any costs of postage incurred upon receipt of those costs. If the courier collection fails for any reason other than fault laying at ours or the arranged courier’s hands, the responsibility of the return and the cost must then be covered by the complainant and no further collection will be offered unless a secondary fee is agreed and paid prior. Please note: we only cover the cost of returns within the UK mainland.

Replacement parts are sent via courier and these are sent only to the delivery address shown at purchase (UK mainland only, see below). In the event a part is no longer available or has been upgraded or revised, the updated replacement will be provided along with any other accompanying parts if it is part of a set and it is deemed to affect the product's aesthetics.

The showers are sold and provided in “kit form”. MEANING - every part can easily be removed and exchanged. The warranty herein does not cover any expense (Either original or further costs) relating to the fitting of replacement parts either in entirety or part (percentage of costs incurred).

Warranty is for residential use and properties only as the purpose of use for all items. In no circumstance will any commercial use be covered in any aspect of the warranty unless prior written confirmation to the contrary is given prior to purchase.

Items must be checked within 48 hours of delivery for cosmetic suitability – Any claims after this time may not be considered as it becomes increasingly difficult to determine the source of any cosmetic defect. This is also fundamental as to ensure any installation can take part as intended without delays

No installation should take place until all items have been deemed cosmetically acceptable. Once installation commences all products then enter into their governing warranty periods and no returns can be accepted, by commencing with the installation you are accepting the goods.

General

All products come with a 12-month warranty as standard. This warranty period can be extended to the period stated in the product literature and advertisement upon registration. Some items carry an option to purchase/upgrade to an extended warranty period. This extended warranty MUST be purchased alongside the product from the retailer and be registered on our website.

The starting date for all warranties is the day of the delivery of the item to the consumers delivery address.

Registration of all warranties (regular and extended) is provided on our website and MUST take place within 90 days of delivery. Failure to register this extended warranty on the site along with the requested details on our submission page FOUND HERE and within the products, instructions will render the extended warranty null and void and will be terminated in essence and practice. Failure to register the warranty will void any additional extended warranty periods purchased and the warranty coverage will then revert to a 12 months period. No refund can be given for failure to register a warranty either by us or the retailer once this period has expired. Steam Shower cabinsWhirlpool bathssteam generators and Hydro showers with electric features MUST have a part “P” installation certificate number provided on the submission form. This should be supplied to you by the tradesperson(s), a company working on the electrics within the bathroom. If this number is not confirmed – any warranty claim cannot be accepted relating to electronic issues or failure resulting from malpractice or issues not certain to be a product fault. The “Part P” is a government-backed scheme that is designed to ensure safe practice and the correct installation of electrical items in the home.

All our products are designed for DIY build, service, and maintenance – The warranty does not cover reimbursement for any time or expense incurred from 3rd party labour costs. If these services are employed, they are done so at the customer discretion and in the event the owner has chosen to employ an installation service we cannot be liable for any incurred expense. This includes any costs for installation, serving or replacing of parts.

All items/parts that make up the sum of the products are covered with the following exceptions:

The Replacement and/or repair of any unit which has been opened/tampered with from the factory seal (I.E steam generator/control panel/electric box).

Any item where calcium build up (hard water) is suspected to be the cause of the reported issue is not covered by the warranty. It is advised a water softener or another solution is called upon to rectify hard water issues such as calcium build up at the source to prevent any occurrence of problems. If you are known to be in a hard water area, fitting a water softener is essential. If you are unsure if you live in a hard water area you should contact your water board or relevant online information source. If the case where an item is returned to base for testing and calcium buildup is present, images will be taken by our testing team and provided back to you along with an accompanying report. If it is suspected calcium buildup is the reason of the issue this is not covered by the warranty as it is not product fault – A return of the original part or a paid replacement will be offered.

All items including steam generator units are for domestic use only. Installation with a commercial property, including but not exclusive to guest houses, dormitory, “large-scale” rental property or similar is not covered under the warranty.

LEDs, light bulbs and chromotherapy lights have a 12 month warranty period as these are considered a ‘consumable durable’ that by design are not intended to last for an entirety.

Glass panels, metal profiles and chrome fittings are not covered by the warranty. As each of these items can be considered a solid component – In their supplied state they cannot degrade after original installation from the contact with water alone– Peeling or marking of the finish or paint can only occur due to contact with corrosive cleaning agents containing bleach or acidic elements. None of the materials within the products will degrade through contact with water or non-harsh, overly powerful cleaning agents.

Hydro showers, Steam showerswhirlpool baths or any item connected to a live water feed must be fitted with isolation taps (like a washing machine/dishwasher) and turned off when not in operation.


Making a Warranty Claim

All warranty claims are to be made exclusively by email to us using the warranty claims form on our website regardless of the origin of the purchase. This enables us to confirm the order information and has written a record of the reduction of our spare parts inventory. No warranty claims can be discussed or commented upon over our phones systems. This also allows both parties to obtain a written record of everything that has transpired

When any part or equipment has been replaced you will be responsible for disposing of the original equipment at your own cost if it remains in your possession and has not been instructed to be returned. The warranty is for replacement and does not offer a swap or collection service.

A number of claims for replacement parts during the warranty period are unlimited

All shower cabins must be fitted with isolation taps/points. These isolation taps should be turned off when not in operation.

Additional guidelines on how to operate and use your product correctly will be provided on the product advertisement on the purchasing site and within the product's instructions – You must adhere to these given guidelines.

Equipment must not be used in any manner other than those listed here and in the items instructions. Neglected and poorly installed items, items subjected to external damage are not covered by the warranty. Your product must in all cases have been serviced in accordance to our recommendations.

All product warranties are covered only within the UK mainland to the delivery address. If a retailer chooses to sell to an address outside UK mainland you should discuss with them if there is any additional cover for the delivery of warranty items. If the product or address for receipt of parts under warranty is outside UK mainland, parts are still provided through warranty although the fee/cost for the delivery of the parts is payable by the recipient.
